AskListing, Inc. ("AskListing," "we," "us," or "our") operates the AskListing platform, an AI-powered real estate assistant that enables buyers to get instant answers about property listings via SMS, voice, and web chat, and enables agents and brokerages to capture and manage qualified leads. This Privacy Policy describes what information we collect, how we use and share it, and your rights with respect to that information.
By using our platform (including by texting or calling a listing number, scanning a QR code, submitting a lead capture form, or using the agent dashboard), you agree to this Privacy Policy. If you are an agent or brokerage using AskListing as a platform customer, your organization's use is also governed by your Master Services Agreement with AskListing.
1. Who This Policy Covers
This policy covers two categories of users:
- Buyers: individuals who interact with a listing via SMS, voice call, QR code scan, or web chat to ask questions about a property.
- Platform Users: real estate agents, brokers, and brokerage administrators who subscribe to AskListing to manage listings, receive leads, and access the dashboard.
2. Information We Collect
From Buyers:
- Name, phone number, and email address (when voluntarily provided)
- The content of your conversations with our AI (questions asked, property inquiries, showing requests)
- Your mobile carrier and device type (from SMS metadata)
- IP address and browser/device information (from web chat)
- The specific listing you inquired about and the time of contact
From Platform Users (Agents & Brokerages):
- Name, email address, phone number, and professional license information
- Brokerage name, address, and MLS affiliation
- Payment information (processed by Stripe; we do not store full card numbers)
- Listing details, property documents, and marketing materials you upload
- CRM credentials or API tokens you provide to enable integrations
- Dashboard usage and activity logs
Automatically Collected:
- Log data (request timestamps, error logs, response codes)
- Analytics data (page views, session duration, feature usage) via privacy-respecting first-party analytics
3. How We Use Your Information
For Buyers, we use your information to:
- Power AI-driven responses to your property questions
- Connect you with the listing agent or brokerage as a qualified lead
- Send follow-up messages you have consented to receive
- Improve AI response quality and conversation flow
For Platform Users, we use your information to:
- Provide and maintain the AskListing platform
- Deliver leads and lead activity to your dashboard and CRM
- Process subscription payments
- Send service notifications, product updates, and support communications
- Generate analytics about listing engagement and lead quality
4. Consent to Contact: TCPA Disclosure
AskListing uses Telnyx to deliver SMS and AI voice communications. Our voice assistant uses AI-generated speech, which is classified as "artificial or prerecorded voice" under the Telephone Consumer Protection Act (TCPA) per FCC Declaratory Ruling FCC 24-17 (February 8, 2024). By submitting your information or initiating contact with a listing, you provide the following consent:
Your mobile phone number will not be sold or shared with third parties for their own promotional or marketing purposes. We share your contact information with the relevant listing agent and brokerage, and with service providers who help us operate the platform (see Section 5).
5. How We Share Your Information
We share information only as described below. We do not sell your personal information.
- Listing Agents and Brokerages. When you interact with a listing, your contact information and conversation summary are shared with the agent and brokerage associated with that listing. This is the core function of the platform. You consent to this sharing by engaging with the listing.
- CRM Platforms. Agents and brokerages may configure AskListing to deliver lead data to their CRM (e.g., Follow Up Boss, Salesforce, HubSpot). Lead data delivered to a CRM is then governed by that CRM provider's privacy policy in addition to this policy.
- Telnyx. We use Telnyx, Inc. to deliver SMS and voice communications. Telnyx processes your phone number and message content as a service provider subject to their own data processing terms.
- Cloudflare. Our platform runs on Cloudflare's infrastructure. Cloudflare processes request data subject to their data processing addendum.
- AI Providers. Conversation content is processed by AI model providers to generate responses. We use API integrations that limit data retention and prohibit training on your data.
- Stripe. Payment information for Platform Users is processed by Stripe, Inc., which is subject to Stripe's privacy policy.
- Legal and Safety. We may disclose information if required by law, court order, or to protect the rights, property, or safety of AskListing, our users, or the public.
- Business Transfers. In the event of a merger, acquisition, or asset sale, your information may be transferred. We will notify you via email and/or a prominent notice on our website.
6. AI-Powered Conversations
AskListing uses artificial intelligence to respond to buyer inquiries about property listings. When you text or call a listing number, you are communicating with an AI assistant, not a human agent. Our AI:
- Answers questions about the property based on information provided by the listing agent
- May ask follow-up questions to qualify your interest or schedule a showing
- May generate voice responses using AI-generated speech (not a real person's voice)
- Does not provide real estate advice, legal advice, or financial advice
Conversations may be escalated to a human agent if the AI cannot answer your question or if the listing agent has configured escalation rules. When an escalation occurs, a human agent will take over the conversation.
Conversation transcripts are stored and shared with the listing agent as part of the lead record. By engaging in a conversation, you consent to this recording and sharing.
7. Data Retention
- Buyer conversation and lead data is retained for as long as the associated brokerage account is active, plus a 90-day grace period following account closure, unless a longer period is required by law or agreed in writing.
- Platform User account data is retained for the duration of the subscription plus 2 years, to support record-keeping and legal obligations.
- SMS opt-out records (STOP requests) are retained indefinitely to honor your opt-out preference.
- Payment records are retained as required by applicable tax and financial regulations (typically 7 years).
You may request deletion of your personal data at any time subject to Section 8 (Your Rights) and our legal retention obligations.
8. Your Privacy Rights
All Users may:
- Opt out of SMS communications at any time by replying STOP to any text message from AskListing
- Request a copy of the personal information we hold about you
- Request correction of inaccurate personal information
- Request deletion of your personal information (subject to legal retention requirements)

California Residents (CCPA/CPRA): If you are a California resident, you have additional rights under the California Consumer Privacy Act as amended by the California Privacy Rights Act:
- Right to Know. You may request disclosure of the categories and specific pieces of personal information we have collected about you in the past 12 months, the categories of sources, the business or commercial purposes for collection, and the categories of third parties with whom we share your information.
- Right to Delete. You may request deletion of personal information we have collected from you, subject to certain exceptions (e.g., information necessary to complete a transaction, detect security incidents, or comply with a legal obligation).
- Right to Correct. You may request correction of inaccurate personal information.
- Right to Opt-Out of Sale or Sharing. We do not sell personal information. We do not share personal information for cross-context behavioral advertising.
- Right to Limit Use of Sensitive Personal Information. We do not use sensitive personal information beyond the purposes for which it is collected.
- Right to Non-Discrimination. We will not discriminate against you for exercising any CCPA rights.
To submit a California privacy request, email privacy@asklisting.com with "California Privacy Request" in the subject line. We will verify your identity and respond within 45 days (extendable by an additional 45 days when reasonably necessary).
9. Data Security
We implement technical and organizational security measures appropriate to the risk, including TLS encryption in transit, encrypted storage, access controls, and regular security reviews. However, no method of transmission over the Internet or electronic storage is 100% secure. We cannot guarantee absolute security.
In the event of a data breach that is likely to result in a risk to the rights and freedoms of individuals, we will notify affected users and applicable regulators as required by law.
10. Children's Privacy
AskListing is not directed to individuals under 18 years of age. We do not knowingly collect personal information from children under 18. If you believe we have inadvertently collected such information, please contact us at privacy@asklisting.com and we will delete it promptly.
11. Third-Party Links
Our platform may contain links to third-party websites, including MLS listings or brokerage websites. We are not responsible for the privacy practices of third parties and encourage you to review their privacy policies.
12. Changes to This Policy
We may update this Privacy Policy from time to time. Material changes will be communicated by updating the "Last Updated" date above and, where required by law, by providing more prominent notice (such as an email notification to Platform Users). Your continued use of the platform after the effective date of any update constitutes acceptance of the revised policy.
